Canadian Immigration Laws: Permanent Residence Status

Acquiring a Canadian immigrant visa confers as the permanent status of the applicant to hold the equal rights and privileges as those of a Canadian citizen (i.e. free health care, free elementary and secondary education, subsidized post-secondary education, the eligibility to work in Canada) with just a few exceptions.

Unlike Canadian citizens,

  • A permanent resident cannot hold the rights to vote
  • A permanent resident is not eligible to hold a Canadian passport
  • A permanent resident shall be deported for certain criminal convictions under the country’s law.

For an applicant, to obtain permanent Canadian Citizenship in the country, he/she needs to stay in the country for at least a total of 1095 days within four (4) consecutive years. Also, he / she will also be eligible to apply for a Canadian passport after obtaining Canadian Citizenship.

According to the Immigration and Refugee Protection Act of Canada, a permanent resident must reside in the country for a total of at least 730 days within the five (5) years prior to the date of expiration in order to be eligible for renewing the Permanent Resident Card, subject to certain exceptions.

To whomsoever, a Canadian immigrant visa issued must present themselves to a Canadian Immigration officer at one of the official ports of Canada entry, in order to become a permanent resident of the country.

The aspiring resident must meet the requirements for permanent residency in Canada. (1) of five (5) classes of Immigration to become a permanent resident of Canada: The Federal Skilled Worker Class, the Canadian Experience Class, the Federal Skilled Trade Class, the Family Class, or the Business Class to qualify as a provincial nominee.
